End User License Agreement (EULA) & Terms of Use — VeloWalk

This End User License Agreement ("Agreement") is a legal agreement between you and Verzir Tech ("Developer") for the use of the VeloWalk application ("App"). By downloading or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

This is a custom EULA. If you do not provide one, Apple's Standard EULA applies by default.

1. License
The Developer grants you a limited, non‑exclusive, non‑transferable, revocable license to use the App on any Apple device that you own or control, as permitted by the Apple Media Services Terms and Conditions (Licensed Application End User License Agreement). This license is for your personal, non‑commercial use.

2. Restrictions
You agree not to:

copy, modify, reverse‑engineer, decompile, or disassemble the App, except where permitted by applicable law;
rent, lease, lend, sell, sublicense, or distribute the App;
remove or alter any proprietary notices;
use the App in any unlawful manner or in violation of any applicable regulation.
3. Health & fitness disclaimer
VeloWalk is a fitness and activity‑tracking tool, not a medical device. The information it provides — including heart rate, heart‑rate zones, calories, distance, pace, recovery and readiness estimates — is for general informational and motivational purposes only and is not medical advice.

Consult a qualified physician before starting or changing any exercise program, especially if you have a medical condition.
Do not rely on the App for medical decisions or emergencies.
Heart‑rate and calorie figures are estimates and may be inaccurate.
You exercise at your own risk; stop and seek medical help if you feel unwell.
4. User content & data
You are responsible for the data you record in the App. The App stores your data locally on your device and, optionally, in your own iCloud account. Please see our Privacy Policy for details on how your information is handled.

5. Third‑party services
The App integrates with Apple services (HealthKit, Apple Weather, Apple Music, iCloud) and may connect to third‑party Bluetooth sensors. Your use of those services and devices is subject to their own terms. The Developer is not responsible for third‑party services or hardware.

6. Intellectual property
The App, including its design, code, graphics, and trademarks, is owned by the Developer and protected by intellectual‑property laws. No rights are granted except the limited license in Section 1.

7. No warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON‑INFRINGEMENT. The Developer does not warrant that the App will be uninterrupted, error‑free, or accurate.

8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH/PERSONAL INJURY, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP.

9. Apple as a third‑party beneficiary
You acknowledge that this Agreement is between you and the Developer only, not with Apple. Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third‑party beneficiaries of this Agreement and may enforce it against you. Maintenance, support, and warranty claims are the Developer's responsibility, not Apple's, to the extent required by law.

10. Termination
This Agreement is effective until terminated. Your rights end automatically if you breach it. Upon termination, you must stop using and delete the App.

11. Governing law
This Agreement is governed by the laws of [your country/jurisdiction — e.g. Republic of Türkiye], without regard to conflict‑of‑law rules, unless overridden by mandatory local consumer‑protection law.
