Fitluma Son Kullanıcı Lisans Sözleşmesi (EULA)

Fitluma uygulamasını ("Uygulama") indirerek veya kullanarak bu sözleşmeyi kabul etmiş olursunuz. Kabul etmiyorsanız Uygulamayı kullanmayın. Bu sözleşme, Apple'ın Standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi'ni tamamlar; çelişki hâlinde buradaki ek hükümler geçerlidir.
1. Lisans
Geliştirici size, Uygulamayı sahip olduğunuz veya kontrol ettiğiniz Apple markalı cihazlarda, App Store Kullanım Kuralları'na uygun olarak kişisel ve ticari olmayan amaçlarla kullanmanız için sınırlı, münhasır olmayan, devredilemez bir lisans verir. Uygulama size satılmaz, lisanslanır.
2. Kısıtlamalar
Uygulamayı kopyalayamaz, değiştiremez, dağıtamaz, satamaz, kiralayamaz; kaynak koduna dönüştüremez veya tersine mühendislik yapamazsınız (yürürlükteki yasaların açıkça izin verdiği hâller hariç). Uygulamadaki egzersiz içerikleri, animasyonlar ve diğer materyaller Geliştiriciye veya lisans verenlerine aittir ve yalnızca Uygulama içinde kişisel kullanım içindir.
3. Sağlık ve güvenlik uyarısı — TIBBİ TAVSİYE DEĞİLDİR
Fitluma yalnızca genel fitness ve bilgilendirme amaçlıdır. Uygulama, yapay zekâ koçu dâhil, tıbbi tavsiye, teşhis veya tedavi sunmaz ve bir doktor, fizyoterapist veya diyetisyenin yerini tutmaz. Herhangi bir egzersiz programına başlamadan önce doktorunuza danışın. Egzersiz sırasında ağrı, baş dönmesi veya nefes darlığı hissederseniz derhâl durun ve tıbbi yardım alın. Egzersizlerin uygulanmasından doğabilecek yaralanma ve sağlık sorunlarının riski size aittir.
4. Yapay zekâ içeriği
Yapay zekâ koçunun ürettiği planlar, öneriler ve form analizi sonuçları otomatik olarak üretilir; hatalı veya size uygun olmayan içerik içerebilir. Bu çıktıları kendi durumunuza göre değerlendirmek sizin sorumluluğunuzdadır.
5. Reklamlar ve üçüncü taraf hizmetleri
Uygulama, Google AdMob aracılığıyla reklam gösterir. Reklamların içeriğinden reklam verenler sorumludur. Üçüncü taraf hizmetleri (Apple Sağlık, iCloud, AdMob) kendi koşullarına tabidir.
6. Verileriniz
Verilerinizin nasıl işlendiği Gizlilik Politikası'nda açıklanır. Verileriniz cihazınızda saklandığı için yedeklenmesi (ör. iCloud senkronu veya cihaz yedeği) sizin sorumluluğunuzdadır; veri kaybından Geliştirici sorumlu tutulamaz.
7. Garanti reddi
Uygulama "olduğu gibi" ve "mevcut hâliyle", açık veya zımni hiçbir garanti olmaksızın sunulur. Geliştirici, Uygulamanın kesintisiz, hatasız veya belirli bir amaca uygun olacağını garanti etmez.
8. Sorumluluğun sınırlandırılması
Yürürlükteki yasaların izin verdiği azami ölçüde Geliştirici; kâr kaybı, veri kaybı, yaralanma dâhil dolaylı, arızi veya sonuçsal zararlardan sorumlu değildir. Ücretsiz sunulan bu Uygulama için toplam sorumluluk, yasal olarak indirgenemeyen hâller dışında, 50 ABD Doları ile sınırlıdır. Bu sınırlamalar, kasıt veya ağır ihmal hâllerinde ve tüketicinin yasal haklarını ortadan kaldıracak şekilde uygulanmaz.
9. Fesih
Bu lisans, koşullara uymamanız hâlinde kendiliğinden sona erer. Uygulamayı cihazınızdan silerek istediğiniz an sonlandırabilirsiniz.
10. Güncellemeler ve değişiklikler
Geliştirici, Uygulamayı ve bu sözleşmeyi güncelleyebilir veya Uygulamayı sunmayı durdurabilir. Güncel sözleşme bu sayfada yayımlanır; Uygulamayı kullanmaya devam etmeniz değişiklikleri kabul ettiğiniz anlamına gelir.
11. Uygulanacak hukuk
Bu sözleşme Türkiye Cumhuriyeti yasalarına tabidir; tüketiciler, ikamet ettikleri ülkenin emredici tüketici koruma hükümlerinden yararlanmaya devam eder.

Fitluma End User License Agreement (EULA)

By downloading or using the Fitluma app (the "App") you agree to this agreement. If you do not agree, do not use the App. This agreement supplements Apple's Standard Licensed Application End User License Agreement; in case of conflict, the additional terms here prevail.
1. License
The Developer grants you a limited, non-exclusive, non-transferable license to use the App on Apple-branded devices you own or control, for personal, non-commercial purposes, in accordance with the App Store Usage Rules. The App is licensed to you, not sold.
2. Restrictions
You may not copy, modify, distribute, sell or rent the App, nor decompile or reverse-engineer it (except as expressly permitted by applicable law). Exercise content, animations and other materials belong to the Developer or its licensors and are for personal use within the App only.
3. Health & safety notice — NOT MEDICAL ADVICE
Fitluma is for general fitness and informational purposes only. The App, including the AI coach, does not provide medical advice, diagnosis or treatment and is not a substitute for a physician, physiotherapist or dietitian. Consult your doctor before starting any exercise program. Stop immediately and seek medical help if you feel pain, dizziness or shortness of breath. You assume the risk of injury or health issues arising from performing exercises.
4. AI-generated content
Plans, suggestions and form-analysis results produced by the AI coach are generated automatically and may be inaccurate or unsuitable for you. Evaluating these outputs against your own condition is your responsibility.
5. Advertising & third-party services
The App displays ads via Google AdMob. Advertisers are responsible for ad content. Third-party services (Apple Health, iCloud, AdMob) are subject to their own terms.
6. Your data
How your data is handled is described in the Privacy Policy. Because your data is stored on your device, backing it up (e.g. iCloud sync or device backup) is your responsibility; the Developer is not liable for data loss.
7. Disclaimer of warranty
The App is provided "as is" and "as available", without warranties of any kind, express or implied. The Developer does not warrant that the App will be uninterrupted, error-free or fit for a particular purpose.
8. Limitation of liability
To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental or consequential damages, including lost profits, data loss or injury. For this free App, total liability is limited to USD 50, except where such limits cannot be reduced by law. These limitations do not apply in cases of intent or gross negligence and do not affect your statutory consumer rights.
9. Termination
This license terminates automatically if you fail to comply with its terms. You may terminate it at any time by deleting the App from your device.
10. Updates & changes
The Developer may update the App and this agreement, or discontinue the App. The current agreement is published on this page; continued use of the App constitutes acceptance of changes.
11. Governing law
This agreement is governed by the laws of the Republic of Türkiye; consumers continue to benefit from the mandatory consumer-protection rules of their country of residence.
